Remory Inc. ("Remory," "we," "us," or "our") provides a sleep- and memory-wellness experience consisting of: an online store and website; a mobile app for iPhone and Apple Watch (the "App"); a connected Bluetooth device (the "Device"); and the related cloud services, content, features, and tools (together, the "Services"). Our store and website are powered by Shopify.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit or use the Services, create an account, connect a wearable or the Device, capture study material, make a purchase, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have read and understand it.

Health data, in plain terms. Remory works with sensitive health and wellness information — your sleep, and in some cases heart rate and related metrics, plus the study material you choose to save. We use this information only to provide the Services to you. We do not sell it, and we do not use your health, biometric, study-content, wearable, or Device-usage data for advertising or marketing. See "Health and Wellness Data" below.

Personal Information We Collect or Process

When we use the term "personal information," we mean information that identifies or can reasonably be linked to you. Depending on how you use the Services, we may collect or process:

  • Contact details — name, billing/shipping address, phone number, and email address.
  • Account information — your login credentials (managed through our authentication provider), preferences, and settings.
  • Financial / payment information — payment card and transaction details for store purchases. Card payments are processed by Shopify and its payment processors; we do not store full card numbers.
  • Transaction information — items you view, add to cart or wishlist, and your purchases, returns, and exchanges.
  • Health and wellness data (App) — your sleep and related physiological metrics, obtained from Apple Health (HealthKit) and/or from wearables you connect (e.g., Oura, Withings, Fitbit). Depending on your device and permissions, this can include sleep sessions and sleep stages, heart rate, lowest resting heart rate, heart-rate variability, respiratory rate, and sleeping wrist temperature (on supported Apple Watch models). From this we derive, and store on our servers, a compact per-night sleep summary — such as your deep-sleep bouts, sleep onset, and cycle length, together with nightly averages of the metrics above. We use this to detect sleep, predict when your deep sleep is likely to occur so we can time your sessions, personalize the Services, and show you your own history.
  • Sleep-timing predictions (App) — the predictions our model makes about when your deep sleep will occur, and comparisons of those predictions against your actual sleep. We store these on our servers to time your sessions and to improve the accuracy of the prediction model. They are derived from your sleep and physiological data only.
  • Connected wearable data (App) — when you connect a third-party wearable (e.g., Oura, Withings, or Fitbit), the authorization tokens that let us retrieve your data on your behalf, and the sleep-related data we retrieve from that provider. Tokens are stored encrypted.
  • Device (canister) data (App) — Bluetooth pairing identifiers, firmware version, and usage information such as the dates/times your Device is activated or used during a session.
  • Study material you provide (App) — the notes, text, and images you capture or upload to create study content, and the audio we generate from that content for you.
  • Recall and quiz data (App) — your answers to baseline and daily recall checks, the scores and feedback generated for them, and your progress over time.
  • Coach interactions (App) — messages you send to, and receive from, the in-app coaching feature.
  • Communications with us — information you include when you contact support or otherwise reach out.
  • Device and technical information — information about your device, app version, browser or network connection, IP address, and similar identifiers.
  • Usage information — how and when you interact with and navigate the Services.

We may also derive inferences from the above (for example, which study topics need reinforcement) solely to operate and personalize the Services for you.

Personal Information Sources

  • Directly from you — when you create an account, make a purchase, capture study material, message the coach, or contact us.
  • Automatically — from your device and the App as you use the Services, including through cookies and similar technologies on our website.
  • From your device's health store and connected services, with your permission — Apple Health (HealthKit) and any wearable you choose to connect.
  • From our service providers and partners — when they collect or process information on our behalf (see "How We Disclose").

How We Use Your Personal Information

  • Provide and operate the Services. To perform our contract with you: create and manage your account; process payments, orders, returns, and exchanges; arrange shipping; pair and operate your Device; process the study material you provide into audio; run your recall checks; detect and reconcile your sleep; predict when your deep sleep is likely to occur so we can time your sessions, and check those predictions against your actual sleep to improve the model; and personalize the study content we prepare for you.
  • Improve and secure the Services. To understand how the Services are used, maintain reliability, debug and fix problems, and protect against fraud, abuse, and unauthorized access.
  • Communicate with you. To provide customer support, respond to you, and send service messages about your account, orders, or the Services.
  • Marketing (store only). To send promotional messages about our products and store and to show you advertising. We use only contact, account, transaction, and general usage information for marketing — never your health, biometric, wearable, study-content, recall, or Device-usage data. You can opt out of promotional messages at any time (see "Your Rights and Choices").
  • Legal and safety. To comply with applicable law, respond to lawful requests and legal process, and enforce our terms and protect our rights and the rights and safety of others.

Automated processing by AI service providers

To provide certain features, content you give us is processed by third-party artificial-intelligence and speech providers acting as our service providers:

  • The study material and coach messages you provide, and your recall answers, are processed by our AI provider (Anthropic / "Claude") to generate study content, coaching responses, and recall scoring/feedback.
  • Your study content is converted to spoken audio by a text-to-speech provider (Google Cloud).

These providers process your content only to perform the requested function on our behalf. Under our agreements with them and their terms, they do not use your content to train their AI models. This processing supports the Services; it does not make automated decisions that produce legal or similarly significant effects about you.

Health and Wellness Data (including Apple HealthKit)

This section governs your sleep, heart-rate, and other health/biometric data, your connected-wearable data, your study content, recall data, and Device-usage data (together, "Health and Wellness Data").

  • We access Apple Health (HealthKit) data only after you grant permission, and only the categories needed to provide the Services (such as sleep and, where permitted, heart rate).
  • We use Health and Wellness Data solely to provide the Services to you — for example, detecting and timing your sessions, reconciling sleep across sources, and personalizing your study content and progress reporting.
  • To time your sessions accurately, we store on our servers a derived per-night summary of your sleep (including sleep-stage structure and nightly averages of metrics such as heart rate, heart-rate variability, respiratory rate, and — on supported Apple Watch models — sleeping wrist temperature), along with our predictions of when your deep sleep will occur and how those predictions compared to your actual sleep. This is derived from your sleep and physiological signals only. We use it only to time your sessions and to improve the accuracy of the prediction model — never for advertising, and it is never combined with or linked to your study, recall, or quiz activity.
  • We do not use Health and Wellness Data for advertising or marketing, we do not sell it, and we do not share it with third parties for their own purposes. Consistent with Apple's requirements, we do not use HealthKit data for advertising or data-mining, and we do not disclose it to third parties except service providers who help us operate the Services (see "How We Disclose").
  • You can revoke the App's access to Apple Health at any time in iOS Settings → Privacy & Security → Health, and you can disconnect a wearable at any time in the App.

Connected Wearables

If you connect a third-party wearable (e.g., Oura, Withings, or Fitbit), you authorize us to retrieve sleep-related data from that provider on your behalf. We store the authorization tokens encrypted and use the retrieved data only to provide the Services. When you disconnect a wearable in the App, we stop retrieving your data and delete the tokens we hold. You may also revoke Remory's access directly with the wearable provider through that provider's account settings, which we recommend if you want to be certain access is withdrawn on their side as well. Each wearable provider handles your data under its own privacy policy.

The Device (Canister)

The Device communicates with the App over Bluetooth. In connection with this, we process pairing identifiers, firmware version, and usage/activation information (such as when the Device is used during a session) to operate the Device and your sessions and to show you your history.

How We Disclose Personal Information

We do not sell your personal information, and we do not share your Health and Wellness Data for cross-context behavioral advertising. We may disclose personal information in these circumstances:

  • To service providers ("processors") who perform services for us and process information on our instructions, including:
    • Shopify — store/website hosting, checkout, and commerce features;
    • Supabase — account authentication and database storage;
    • Render — backend application hosting;
    • Google / Firebase — cloud functions, file storage, and text-to-speech;
    • Anthropic — AI processing for study content, coaching, and recall scoring;
    • Sentry — crash and error monitoring;
    • payment processors engaged through Shopify.
  • To wearable providers you connect (Oura, Withings, Fitbit) — only to authenticate and retrieve the data you authorize.
  • Store marketing partners — for store advertising and analytics, using only non-health information as described in "Marketing (store only)." Depending on where you live, you may direct us not to share information for targeted advertising.
  • When you direct or consent — for example, to ship your order or when you use a social or login integration.
  • With our affiliates or within our corporate group.
  • For legal, safety, and business-transfer reasons — to comply with law and legal process, enforce our terms, protect our rights and the rights and safety of others, and in connection with a merger, acquisition, financing, or bankruptcy.

Relationship with Shopify

Our store and website are hosted by Shopify, which collects and processes information about your access to and use of the store in order to provide and improve it. Information you submit through the store is transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. Shopify may also use certain enhanced features that incorporate data from your interactions with our store and other merchants. In these circumstances Shopify is responsible for that processing, including responding to your requests regarding it. (Note: this section applies to the store/website; your App, health, and Device data are handled by Remory and the service providers listed above, not Shopify.)

Third-Party Websites and Links

The Services may link to websites or platforms operated by third parties. We are not responsible for their privacy or security practices. Review their policies before providing information. Information you share on public or third-party platforms may be viewable by others.

Children's Data

The Services are not directed to, and we do not knowingly collect personal information from, anyone under 18. If you believe a child has provided us personal information, contact us (below) and we will delete it. We do not knowingly "sell" or "share" the personal information of individuals under 16.

Security and Retention

We use technical and organizational measures designed to protect personal information, including encryption of data in transit and of sensitive data (such as wearable tokens) at rest, access controls, and database-level access restrictions. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security; please do not use insecure channels to send us sensitive information.

We retain personal information for as long as needed to provide the Services and maintain your account, and thereafter as needed to comply with legal obligations, resolve disputes, and enforce our agreements. When you delete your account (see below), we delete the personal information associated with it from our active systems, including your study content, recall data, sleep/health events, your per-night sleep summaries and sleep-timing predictions, Device-usage records, and the audio generated for you; residual copies may persist briefly in backups and where retention is required by law.

Your Rights and Choices

Depending on where you live, you may have some or all of these rights. They are not absolute and may apply only in certain circumstances.

  • Access / Know — request the personal information we hold about you. The App also lets you export your data directly.
  • Delete — request deletion of your personal information. You can delete your account and data from within the App.
  • Correct — request correction of inaccurate personal information.
  • Portability — receive a copy of your information in a portable format.
  • Opt out of marketing — unsubscribe from promotional emails using the link in those emails. We may still send non-promotional service messages (e.g., about your orders or account).
  • Opt out of targeted advertising / "sharing" — where applicable, direct us not to share non-health information for cross-context behavioral advertising.

To exercise these rights, use the controls in the App or contact us using the details below. We will not discriminate against you for exercising your rights. We may need to verify your identity, and we will respond within the time required by applicable law. You may use an authorized agent where permitted, subject to verification.

Complaints

If you have a complaint about how we handle your personal information, please contact us first using the details below so we can try to resolve it. You also have the right to complain to a regulator: in Canada, the Office of the Privacy Commissioner of Canada (and, where applicable, your provincial privacy authority); in the United States, your state Attorney General or applicable state privacy authority.

International Transfers

The Services are offered to users in Canada and the United States. Several of our service providers operate in the United States, so if you are in Canada your personal information may be transferred to, stored, and processed in the United States, where it may be subject to lawful access requests by US authorities. We use contractual and other safeguards designed to ensure your information receives a comparable level of protection when handled by our service providers, consistent with applicable Canadian privacy law.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for operational, legal, or regulatory reasons. We will post the revised policy here, update the "Last updated" date, and provide additional notice where required by law.
